Byers, Texas rancher has a deed for land and has paid taxes on the land for over a hundred years however thirty years ago the federal government took the land and paid nothing for it. Ever since the Louisiana Purchase the boundary has been controversial. The boundary is supposed to be the vegetation line on the south side of the Red River. But over time the River moves both southerly and northerly. That is where the dispute begins.
This river moves often and sometimes rapidly over time. Texas and Oklahoma have different definitions of the process and the Feds are always on the side of Oklahoma. In the past thirty years the river has moved on mile south then one mile north but the movement is caused by different processes according to the governments involved. Therefore the boundary only moves in one direction and never back with the river.
